WAIVER, TERMS AND CONDITIONS

These Terms and Conditions apply to all participants (hereinafter referred to as “the hirer” or “user”) using hire equipment provided by Beyond Adventure Supply (“Beyond”).

Completion of a booking or reservation confirms the hirer’s acceptance of these Terms and Conditions, and the Waiver and Release of Liability.

AGREEMENT

I (the hirer) have carefully read this agreement in its entirety and understand its contents. I acknowledge that this is an assumption of risk and release of liability, and I agree to its terms voluntarily.

GENERAL HIRE TERMS

Hirer Responsibilities

  1. The hirer confirms they are physically and mentally capable of safely using the rented equipment.
  2. The hirer is fully responsible for their actions and decisions while using hired equipment. Beyond is not liable for misuse, injury, or outcomes resulting from user error.
  3. The hirer is responsible for ensuring they have adequate insurance to cover personal injury, loss, or damage during the hire period.
  4. The hirer is fully responsible for any fees, damages, or losses incurred as a result of improper use, negligence, or incidents during the hire period.
  5. The hirer agrees not to use any equipment while under the influence of alcohol or drugs.
  6. The hirer is responsible for ensuring all equipment is used in a safe and lawful manner and in accordance with its intended purpose.

EQUIPMENT CONDITION, LOSS & DAMAGE

  1. A hold may be placed on the hirer’s payment card as security. This will be released upon safe and clean return of the equipment.
  2. All equipment is provided clean, functional, and in good condition. It must be returned in the same state.
  3. Equipment must be returned clean of mud and debris. Excessively dirty items may incur a cleaning fee.
  4. The hirer is responsible for checking the condition of the equipment prior to use and must report any issues immediately.
  5. Normal wear and tear is acceptable. However, damage due to misuse, negligence, or improper handling will be charged at current retail and labour rates.
  6. In the event of theft, the hirer is responsible for the full replacement value of the equipment and any accessories provided.
  7. The hirer authorises Cycle the City or Beyond to charge their payment card for any costs associated with repairs, replacement, or loss.
  8. Insurance Disclaimer: Please note: All hire equipment is not insured while in the possession of the hirer. In the event of loss, theft, or irreparable damage, the full replacement value of the equipment and any accessories will be charged to the hirer. Hirers are encouraged to take out a private insurance policy for the duration of the hire period, especially when renting high-value items.

COLLECTION & USE OF EQUIPMENT

  1. A valid photo ID (passport or driving licence) is required when collecting equipment.
  2. A booking confirmation must be presented upon collection.
  3. While we aim to provide the exact items booked, we reserve the right to substitute items of equal value or functionality if necessary.
  4. We reserve the right to refuse rental to any individual deemed unfit or unprepared for safe use of the equipment.

AGE & SUPERVISION REQUIREMENTS

  1. Hirers must be at least 18 years old. Users under 18 must be accompanied by a responsible adult who accepts liability.
  2. Proof of age may be required at time of hire.

BOOKING CHANGES & CANCELLATIONS

  1. Booking Changes: Contact us at least 24 hours before the hire period to reschedule (subject to availability).
  2. Cancellations:
  • More than 14 days prior: 10% administration fee.
  • Between 7–14 days: 25% of the hire value.
  • Less than 7 days: Full hire cost is charged.

ASSUMPTION OF RISK & WAIVER OF LIABILITY

Understanding the Risks

  • The hirer acknowledges that using outdoor and adventure equipment carries inherent risks, including injury, environmental exposure, equipment failure, and unpredictable conditions.
  • Activities such as camping, hiking, cycling, and using technical gear may result in injury, illness, or loss of property.
  • The hirer confirms they are in good health and physically able to participate in activities associated with the rented equipment.

Waiver and Release

  • By proceeding with the hire, the hirer accepts all associated risks and releases Cycle the City and Beyond Adventure Supply from liability for injury, death, or property loss, even if caused by negligence.
  • The hirer waives the right to pursue legal claims against Cycle the City or Beyond for any incidents arising from equipment hire or associated activities.
  • If hiring on behalf of a minor, the hirer confirms they are the parent or legal guardian and accept full responsibility for the minor’s use of the equipment.

DECLARATION

By completing a booking, I confirm I have read and understood this agreement and accept the Terms and Conditions, Waiver, and Release of Liability as outlined above.
