Cycle the City & Beyond – Hire Terms, Conditions & Waiver

1. Definitions & Company Details
1.1. Company refers to Cycle the City Limited, trading as Beyond Adventure Supply (referred to throughout these Terms as “we”, “us”, or “Beyond”).
1.2. Hirer / Rider / Customer refers to the individual who makes the booking and/or uses the hired equipment.
1.3. Equipment refers to any item hired from us, including but not limited to: bicycles, electric bicycles, helmets, turbo trainers, bags and luggage, roof tents, roof boxes, racks, camping equipment (including lights, sleeping pads, stoves, and accessories), and any associated parts or accessories supplied with the hire.
1.4. Hire Period means the period from collection of the Equipment until it is returned to us.
1.5. By completing a booking or using our Equipment, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, including the Assumption of Risk and Waiver of Liability set out below.

2. General Hire Conditions
2.1. The Hirer must be at least 18 years old to enter into a hire agreement. Additional age restrictions may apply to certain Equipment (see Section 9).
2.2. Proof of identity is required at the time of collection. Accepted forms include a valid passport or photo driving licence.
2.3. We reserve the right to refuse hire or terminate the Hire Period if, in our reasonable opinion, the Hirer is not fit to use the Equipment safely, is under the influence of alcohol or drugs, or is using inappropriate clothing or equipment.
2.4. We may place a pre-authorisation hold or take a security deposit on the Hirer’s payment card prior to release of the Equipment. The amount will be advised at the time of booking or collection.

3. Rider & User Responsibilities (All Equipment)
3.1. The Hirer confirms they are physically and mentally capable of safely using the Equipment they have hired.
3.2. The Hirer is responsible for using the Equipment in a safe, careful, and lawful manner and in accordance with any instructions provided by us or the manufacturer.
3.3. The Hirer is fully responsible for their actions and for the actions of any person using the Equipment with their permission.
3.4. The Hirer must not use, or permit use of, the Equipment while under the influence of alcohol, drugs, or medication that may impair their ability to use the Equipment safely.
3.5. The Hirer is responsible for ensuring they have appropriate insurance coverage for their activities, personal injury, third-party liability, and any loss or damage to personal property.

4. Condition, Inspection & Maintenance
4.1. All Equipment is supplied clean, functional, and in a safe, roadworthy or usable condition (as applicable).
4.2. The Hirer must inspect the Equipment at the time of collection and before use. Any defects or concerns must be reported immediately. Use of the Equipment constitutes acceptance that it is in satisfactory condition.
4.3. The Hirer must not repair, modify, or adjust the Equipment without our prior consent.

5. Damage, Loss & Theft
5.1. The Hirer is responsible for the Equipment for the entire Hire Period.
5.2. The Hirer is liable for any loss, theft, or damage to the Equipment (other than fair wear and tear) occurring during the Hire Period, regardless of fault.
5.3. Fair wear and tear does not include damage caused by misuse, neglect, accidents, improper installation, crashes, or failure to follow instructions.
5.4. If Equipment is lost or stolen, the Hirer agrees to reimburse us for the full replacement value of the Equipment, including any accessories supplied.
5.5. We reserve the right to repair or replace damaged Equipment at our discretion. The Hirer agrees to pay reasonable repair costs, labour charges, and retail prices for replacement parts.
5.6. We are authorised to charge the Hirer’s payment card for any costs arising under this section.

6. Return of Equipment
6.1. Equipment must be returned on time, to the agreed location, and directly to our staff unless otherwise agreed.
6.2. Equipment must be returned clean, dry, and undamaged. Normal road grime is acceptable for bicycles; excessive dirt, mud, or moisture may incur a cleaning fee.
6.3. Late returns may be charged at an additional daily or hourly rate.

7. Item-Specific Conditions
7.1. Bicycles & Electric Bicycles
Helmets must be worn at all times while riding.
The Hirer is responsible for complying with all road traffic laws.
7.2. Turbo Trainers
Turbo trainers must be used indoors, on a stable and level surface.
The Hirer is responsible for ensuring bicycle compatibility and correct setup.
7.3. Bags, Luggage & Bikepacking Equipment
Maximum load limits must not be exceeded.
We accept no responsibility for damage to personal items stored in hired bags.
7.4. Roof Tents, Roof Boxes & Racks
The Hirer is responsible for ensuring vehicle compatibility and correct installation.
We accept no liability for damage to vehicles caused by incorrect installation or use.
Equipment must not be sublet or loaned to third parties.
7.5. Camping Equipment (including lights, sleeping pads, stoves)
Equipment must be used only for its intended purpose.
Fuel, batteries, and consumables are the Hirer’s responsibility unless stated otherwise.

8. Bookings, Changes & Cancellations
8.1. Full payment is required to confirm a booking unless otherwise stated.
8.2. Changes to bookings must be requested at least 72 hours in advance and are subject to availability.
8.3. Cancellation charges may apply as outlined at the time of booking.

9. Age Restrictions & Minors
9.1. Riders under 16 years of age must be accompanied by a responsible adult.
9.2. Bookings involving minors must be made by a parent or legal guardian, who accepts full responsibility for the minor’s use of the Equipment.

10. Assumption of Risk
10.1. The Hirer acknowledges that the use of cycling, camping, and outdoor equipment involves inherent risks, including but not limited to accidents, injury, illness, property damage, and exposure to weather and road or terrain conditions.
10.2. The Hirer voluntarily accepts and assumes all such risks arising from the use of the Equipment.

11. Liability & Waiver
11.1. To the fullest extent permitted by law, the Hirer agrees that Beyond shall not be liable for any loss, damage, injury, or expense arising from the use of the Equipment.
11.2. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be excluded by law.
11.3. Subject to clause 11.2, the Hirer agrees to release and hold harmless Beyond, its officers, employees, and agents from all claims arising out of the hire or use of the Equipment.

12. Force Majeure
12.1. We shall not be liable for failure or delay in performance due to events beyond our reasonable control, including extreme weather, natural disasters, or government restrictions.

13. Governing Law
13.1. These Terms and Conditions are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.

14. Acceptance
14.1. By booking or using any Equipment, the Hirer confirms acceptance of these Terms and Conditions and acknowledges responsibility for the Equipment during the Hire Period.
